DMCA Policy

At ZEPHYRANT.COM, we cherish original creativity—yours and ours. We respond promptly to valid Digital Millennium Copyright Act (DMCA) notices and, where appropriate, remove or disable access to allegedly infringing material.

Definitions

  • Content: Images, text, designs, videos, or other materials appearing on zephyrant.com.
  • Infringing Material: Content alleged to violate another party’s copyright.
  • Notice: A copyright takedown notification that satisfies DMCA requirements.
  • Counter Notice: A response disputing a Notice and requesting restoration of removed material.
  • Designated Address: [email protected] (for all DMCA correspondence).

Our commitment to intellectual property

We respect the rights of copyright holders and will act on valid Notices. When we remove or disable access to material, we may notify the party who posted it and, where appropriate, share the Notice so they can consider a Counter Notice.

Filing a notice

Start here: A complete DMCA Notice helps us move quickly. Include the following:

  1. Signature: A physical or electronic signature of the copyright owner or authorized agent.
  2. Work identification: Identify the copyrighted work claimed to have been infringed (or a representative list if multiple works at one site are covered).
  3. Location of material: Identify the allegedly infringing material and provide its specific URL(s) on zephyrant.com so we can locate it.
  4. Complainant contact: Your full name, mailing address, telephone number, and email address.
  5. Good-faith statement: A statement that you have a good-faith belief the disputed use is not authorized by the copyright owner, its agent, or the law.
  6. Accuracy and authority statement: A statement that the information in the Notice is accurate and, under penalty of perjury, that you are the copyright owner or authorized to act on the owner’s behalf.

Where to send your notice

Email your complete Notice to: [email protected]. For clarity and speed, include “DMCA Notice” in the subject line and ensure all six elements above are present.

Counter-notification

If your material was removed or disabled and you believe this was a mistake or misidentification, send a Counter Notice that includes:

  1. Signature: Your physical or electronic signature.
  2. Identification: The material that was removed or disabled and the specific URL where it previously appeared on zephyrant.com.
  3. Perjury statement: A statement, under penalty of perjury, that you have a good-faith belief the material was removed or disabled as a result of mistake or misidentification.
  4. Your contact details: Your full name, mailing address, telephone number, and email address.
  5. Jurisdiction and service: A statement that you consent to the jurisdiction of the Federal District Court for the judicial district of your address (or any judicial district in which we may be found if your address is outside the United States) and that you will accept service of process from the person who filed the original Notice or their agent.

Send your Counter Notice to: [email protected] with “DMCA Counter Notice” in the subject line.

What happens next

Upon receiving a valid Notice, we may remove or disable access to the identified material. If we receive a valid Counter Notice, we may restore the material in 10–14 business days unless the original complainant informs us that they have filed a court action seeking to restrain the allegedly infringing activity.

Repeat infringer policy

We may, in appropriate circumstances and at our discretion, limit, suspend, or terminate access for users who are found to be repeat infringers. We also reserve the right to remove content that appears to infringe copyrights, whether or not a formal Notice has been received.

Important reminders

  • Submitting false claims can carry legal consequences. Please ensure your statements are accurate.
  • DMCA addresses copyright only; for trademark or other issues, contact us separately at [email protected].
